Probate Administration

A probate is the administration of an individual’s assets after death.  This can occur either under a will or “intestate” (i.e. without a will).  All probate administrators are Court appointed and subject to the jurisdiction of the Court.

Typically, the job of a probate administrator is to identify the assets and liabilities of a deceased individual.  Secure the assets and pay valid liabilities or claims against the estate.  While the ultimate duty of the administrator is to the heirs, or beneficiaries, of the estate, the administrator’s immediate duty is to creditors, including any taxing authorities (the IRS).

Probate administration is as straightforward or complex as the assets and circumstances of the decedent.
